Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your access to and use of the FLTControlplatform, websites and applications (the "Service"). By using the Service you agree to these Terms. If you use the Service on behalf of an organisation, that organisation's use is also governed by the separate Service Agreement signed with FLTControl, which prevails in the event of any conflict.

2. The Service

FLTControl provides software to help fleet operators manage drivers and vehicles, invoicing, payments, driver wallets, bonuses and work-and-pay (car-loan) arrangements. FLTControl is a technology provider. Payments are processed by independent, licensed payment gateways (such as ShikaCreators and Paystack); FLTControl is not a bank or payment service provider and does not hold your funds as principal.

3. Accounts

You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information, keep it up to date, and notify us promptly of any unauthorised use.

4. Acceptable use

• Use the Service only for lawful purposes and in line with these Terms.
• Do not attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.
• Do not upload unlawful, infringing, or malicious content.
• Organisations are responsible for their relationships with, and obligations to, their drivers — including any loan, hire-purchase, wage or remittance arrangement.

5. Payments and fees

Fees for using the Service are set out in your organisation's Service Agreement or order form. Gateway fees are charged by the relevant payment provider. You are responsible for any taxes or levies that apply to you.

6. Beta service

The Service is provided during a beta period on an "as is" and "as available" basis. Features may change and occasional interruptions may occur. We aim to give reasonable notice of material changes.

7. Limitation of liability

To the maximum extent permitted by law, FLTControlis not liable for indirect or consequential loss, for funds held or processed by payment gateways, or for an organisation's loan or hire-purchase arrangements with its drivers. Nothing in these Terms limits liability that cannot be limited by law.

8. Termination

We may suspend or terminate access if these Terms are breached or where continued use poses a security or legal risk. You may stop using the Service at any time.

9. Governing law

These Terms are governed by the laws of the Republic of Ghana, subject to any dispute-resolution terms in an organisation's Service Agreement.
